Amid accusations that it is targeting pro-lifers to silence and intimidate, the Justice Department has charged 11 more pro-life activists with violations of the Freedom of Access to Clinic Entrances Act for blocking the entrance of an abortion clinic in 2021.
The 11 activists were charged with FACE Act violations stemming from their 2021 “blockade” of an abortion clinic in Mount Juliet, Tennessee. This blockade was peaceful, pro-life activist AJ Hurley told The Daily Signal on Wednesday evening.
Several of the activists were arrested on the day of the blockade, after reportedly successfully preventing abortions from taking place at the clinic for most of the day, but police reportedly released these activists later in the day after they posted bail for misdemeanor charges, the pro-life news outlet Live Action reported.
In a Wednesday press release, the United States Attorney’s Office for the Middle District of Tennessee announced that Chester Gallagher, 73, of Lebanon, Tennessee; Heather Idoni, 58, of Michigan; Calvin Zastrow, 57, of Michigan; Caroline Davis, 24, of Michigan; Coleman Boyd, 51, of Bolton, Mississippi; Dennis Green, 56, of Cumberland, Virginia; and Paul Vaughn, 55, of Centerville, Tennessee, are charged with “conspiracy against rights secured by the FACE Act, and committing FACE Act violations.”
Hurley, a pro-life activist who is friends with many of those charged on Wednesday, told The Daily Signal that the FBI raided Gallagher’s home on Wednesday morning with “guns drawn.” Hurley was not physically present but said he was alerted to the alleged raid by his friends.

“He happened to be in South Carolina, but the neighbors reported and then [the FBI] ended up coming to talk to the neighbors to get his cellphone number, to find out where he was,” Hurley said. “He was in South Carolina, immediately offered to turn himself in to the U.S. Marshals’ office, which they said he could turn himself in tomorrow, so he’ll be turning himself in tomorrow morning.”
Eva Edl, 87, of Aiken South Carolina; Eva Zastro, 24, of Dover, Arkansas; James Zastro, 25, of Eldon, Missouri; and Paul Place, 24, of Centerville, Tennessee, are all charged with committing FACE Act violations as well, the DOJ release said.
Gallagher reportedly used social media to promote pro-life events scheduled for March 2021 in the Nashville area. His fellow pro-life activists, which the Justice Department release calls “co-conspirators,” used “Facebook to coordinate travel and logistics and to identify other participants for the blockade.”
Facebook did not immediately respond to a request for comment from The Daily Signal as to whether it provided intelligence related to the charges filed.
“On March 4, 2021, Coleman Boyd and Chester Gallager advertised the blockade of the Carafem Health Center Clinic, in Mount Juliet, Tennessee, which was planned for the following day,” the release said. “In his social media post, Gallagher referred to the blockade as a ‘rescue.’ Boyd also began a Facebook livestream broadcast of the clinic blockade at 7:45 a.m. on March 5, 2021.”
Hurley explained that a “rescue” means “to forfeit one’s own well-being in a peaceful attempt to save innocent life by placing oneself in between a victim and an oppressor.”
The release continued: “This livestream broadcast was titled, in part, ‘Mt. Juliet, TN Rescue March 5, 2021,’ and livestreamed the blockade event as his coconspirators and others blocked the clinic’s entry doors and prevented a patient and an employee from entering. The livestream also broadcast members of the group attempting to engage a patient and her companion as Boyd told his livestream audience that the patient was a ‘mom coming to kill her baby.’”
On March 5, 2021, according to the release, the pro-life activists, “aided and abetted by one another, used force and physical obstruction to injure, intimidate, and interfere with employees of the clinic and a patient who was seeking reproductive health services.”
If the pro-life activists are convicted, those charged with conspiracy could spend 11 years in prison and fines of up to $250,000, while the others face up to a year in prison and fines of up to $10,000.
The news comes amid national outcry over the dramatic arrest of Mark Houck, a Catholic father and pro-life activist who was reportedly dramatically arrested by armed FBI agents in front of his family for allegedly pushing a pro-abortion activist who allegedly harassed his son.
Neither the FBI nor the U.S. Attorney’s Office for the Middle District of Tennessee immediately responded to requests for comment from The Daily Signal.

So they were arrested for breaking the law? How awful!

I thought you were in favor of law and order?

Yep. For good or ill, Abortion is legal and while you can be for or against it, you CAN'T stop others from doing it or NOT doing it. You don't get to do that in America. Protesting is fine. Lobbying and Campaigning to make it illegal is fine. Stopping others by blocking the entrance is not. This is the Justice system working as designed. Amazing how "Patriotic Americans" (and by this, I mean the extreme ends of both parties) are all about freedom... right up to the point where they don't agree with that freedom. THEN it's ok to do whatever to stop the other guy.

Also there's a big difference between COULD serve a decade in jail and WILL serve a decade in jail. I'm betting that these folks get very little time behind bars unless there's an assault charge involved. That's also while we have a court system and a trial in front of a jury of your peers. IF by chance the Justice Dept overstepped (and that's possible) then the trial in front of a jury will handle it.

These are people in the age range of over 70 dude. They couldnt stop anyone from doing anything. They were basically just loitering with signs and whatever little noise they were making. This is selective prosecution based on the scum running the DOJ going after people based on their political persuasion. What has happened to ANTIFA, BLM and other leftist persons charged with committing serious crimes? NOT A DAMN THING!! This is a sad joke. This is like the grandma that got arrested for walking in the capitol on J6. I sure as hell hope everyones grandmas get treated better than these were by the current regime.

Once again, b/c apparently you are slow. They broke the law by BLOCKING entrance to a lawful activity. That's not loitering or just making noise. As for them being no physical threat, that doesn't matter. IF the folks trying to get in physically forced them out of the way, you'd be on here crying, pissing, and moaning about assault. So yes they can block the entrance. You aren't exempt from the law b/c you are old. Just like the grandma that thought it was OK to go into the capitol building during a riot... you are breaking the law.

I have ZERO problems with putting Antifa and BLM folks in jail if they broke the law. Charge them, try them and lock them up. You see how that works? They law should be the same for everyone. You of course don't get that. You excuse lawbreaking by pointing out someone else that broke the law and think that makes it OK for the people YOU agree with to break the law. It doesn't. If those antifa/blm folks broke the law, that's wrong and they deserve punishment for it. If your folks broke the law, that's wrong and they deserve punishment for it.

As an aside note, I'm assuming that you are talking about the summer riots for your antifa/blm example above. I completely agree that those folks were looters and criminals and needed arresting. But let me remind you of who was President and in charge of the DoJ when this happened. Why didn't Trump do anything? All he did, was sit around and bitch and blame others... which is what he mostly does.

Prison is what happened to them and they deserve it. Cry More MAGA

"It’s a common refrain from some of those charged in the Jan. 6 riot at the U.S. Capitol and their Republican allies: The Justice Department is treating them harshly because of their political views while those arrested during last year’s protests over racial injustice were given leniency.

Court records tell a different story.

An Associated Press review of court documents in more than 300 federal cases stemming from the protests sparked by George Floyd’s death last year shows that dozens of people charged have been convicted of serious crimes and sent to prison.

The AP found that more than 120 defendants across the United States have pleaded guilty or were convicted at trial of federal crimes including rioting, arson and conspiracy. More than 70 defendants who’ve been sentenced so far have gotten an average of about 27 months behind bars. At least 10 received prison terms of five years or more.

The dissonance between the rhetoric of Capitol rioters and their supporters and the record established by courts highlights both the racial tension inherent in their arguments — the pro-Donald Trump rioters were largely white and last summer’s protesters were more diverse — and the flawed assessment at the heart of their claims.

“The property damage or accusations of arson and looting from last year, those were serious and they were dealt with seriously, but they weren’t an attack on the very core constitutional processes that we rely on in a democracy, nor were they an attack on the United States Congress,” said Kent Greenfield, a professor at Boston College Law School."

Yep and he also believes because he hasn't heard about it, then nothing happened. He hasn't heard about it because we aren't defending them and believe they got what they deserve. The First Proud Boy plead guilty to seditious conspiracy yesterday and is expected to serve between 4-5 years. How long before he comes here crying about that because his cause was righteous!

As always a little background context helps when deciphering these stories. This group has been protesting abortion clinics for over 30 years. Most of them have been arrested dozens of times, but only when the protest involves blocking doors or interfering with patients. Typically, they spend a night in jail and pay a fine for misdemeanor charges. They are savvy enough not to get arrested too often in the same State, thus not appearing as a repeat offender on their record. Historically, the charges are local misdemeanors, but it appears this time the DOJ decided to apply FACE Act charges to the 2021 protest, which is well within their jurisdiction.

My biggest beef is that they do all of this in the name of Jesus Christ and truly feel their actions are God-inspired. They feel that any police officer or judge that doesn't let them go is "doing Satan's bidding" and it just emboldens their belief that the world is out to get them. They absolutely LOVE that this is getting press and is gathering sympathy for their "plight". IMO there are so many more constructive ways to carry out pro-life beliefs than to purposefully break the law.

FWIW I've never understood these single-minded groups (almost like cults). And FTR, I'm talking about any group, not necessarily this one that is focused on abortion.

Again the fbi arrested an 87 year old woman singing hymns. Fbi should not even be involved in this...should be a local issue. This is just another example of the obvious weaponization of fbi/ doj. We know the pro life facilities are not being protected in the same manner.

So.... #dontbacktheblue? I'm confused about when I'm supposed to want the police to enforce laws....

I am concerned about selective enforcement and unwarranted enforcement. Is it really illegal to sing hymns on the sidewalk?

It’s not illegal to sing hymns on a sidewalk, but on the event in question, they took it further. If you go back and actually read the GWP article, it tells that the group successfully prevented abortions that day. How did they do that by singing on a sidewalk?

The leader live-streamed the entire event on FB, which is what gave the DOJ the evidence they needed to arrest. It shows them blocking doors in a hallway and interrogating an abortion seeker. The photos can be found easily on the internet. The audacity of the group caught up to them this time, which is why it didn’t end with just local authorities and a misdemeanor.

BTW - grandma has been arrested 47 times. Not sure about your family, but in mine, that’s grounds for not getting invited to Christmas dinner.

I wish Americans would stop defending lawless behavior just because it is conducted by your political allies.
