Special Counsel John Durham scored two major wins on Wednesday ahead of the criminal trial for ex-Clinton campaign lawyer Michael Sussmann, as the judge ordered a key witness to testify and agreed to review memos the defense is trying to conceal with a claim of attorney-client privilege.
During a hearing, U.S. District Judge Christopher Cooper expressed skepticism that memos detailing the Fusion GPS firm’s opposition research on Donald Trump’s ties to Russia – some of which were shared with the news media and the FBI -- were covered by attorney-client privilege and agreed to Durham’s request to review 38 of the documents that prosecutors want to introduce at trial later this month.
Cooper said he wasn’t convinced the Clinton campaign, Sussmann and his law firm and Fusion GPS should have blanket privilege over the documents, at one point citing a memo of Fusion’s contacts with a reporter as evidence of “assisting a media strategy” rather than legal advice.
Cooper also unsealed his order to compel that granted Fusion GPS computer researcher Laura Seago limited immunity and ordered her to testify at trial as Durham sought.

Seago’s lawyer informed prosecutors she planned to “invoke her Fifth Amendment privilege against self-incrimination absent a court order of immunity compelling her to testify at trial,” according to the unsealed records.
Cooper signed an order mandating Seago “give testimony or provide other information which she refuses to give or to provide on the basis of her privilege against self-incrimination as to all matters about which she might be interrogated at trial and any proceedings ancillary thereto.”
The judge also ruled that “no testimony or other information compelled under this Order (or any information directly or indirectly derived from such testimony or other information) may be used against Laura Seago in any criminal case, except a prosecution for perjury, giving a false statement, or otherwise failing to comply with this Order.”
Durham had argued that Seago’s testimony was “necessary to the public interest.” It did not specify what prosecutors believed her testimony would focus on.
Holly Pierson, a lawyer for Seago, did not return a call or email seeking comment Wednesday evening.
Josh Levy, a lawyer for Fusion GPS, also did not return a call seeking comment.
Cooper’s rulings on Wednesday continue a string of victories for Durham in his effort to prosecute Sussmann on a charge of lying to the FBI in 2016 when he shared what proved to be false dirt linking Donald Trump to Russia.
The judge previously rejected Sussmann’s motion to dismiss the charge, ruling last month that the question of whether Sussmann’s alleged lie to the FBi was “a question that generally must be answered by a jury.”

Kash Patel, a former federal prosecutor and the former House Intelligence Committee investigative counsel who helped unravel the Russia case, applauded both of the judge’s decisions.
He said the ruling to review the privileged documents “is a big step towards the utilizations of key documents proving criminality in the Sussman case.”
And Patel said the order to compel Seago’s testimony was one “swinging the gavel of justice in the right direction” and allowing testimony “the Clinton Criminal Cartel wanted blocked.”

As the Biden administration pushes its new Disinformation Governance Board, the FBI's former intelligence chief says he is now convinced Democrat Hillary Clinton's 2016 campaign used "contrived disinformation" to try to mislead Americans into believing Donald Trump was a Russian asset.
"This is more than just political dirty tricks," retired Assistant Director for Intelligence Kevin Brock told the "Just the News, Not Noise" television show Wednesday. "Political dirty tricks usually have some foundation in truth. But they just made stuff up."
Brock, one of the bureau's most respected former executives, said he has been impressed with the way Special Counsel John Durham has used the prosecution of former Clinton campaign lawyer Michael Sussmann to expose how the false Russia collusion narrative was constructed.
Sussmann, who has pleaded innocent and faces trial at the end of the month, is charged with lying to the FBI in fall 2016 when he denied he was acting on behalf of a client in bringing the bureau what turned out to be false allegations that Trump had a secret communications channel with the Kremlin.
Durham has exposed recent evidence showing the Clinton campaign's own researchers were skeptical of the allegation, which one described as a "red herring." The underlying data permitted no more than an "inference" at best, according to another. Last week, prosecutors unveiled an email showing a journalist had told the campaign research team weeks before it approached the FBI that one of the Trump-Russia allegations was "bullshit."
"This is the way disinformation is really exposed, not by some contrived government agency, but by evidence presented in court that gets at the truth of what happened," Brock said of the prosecutor's recent evidentiary filings in court. "What Durham is methodically doing, is laying out a case that the Hillary Clinton campaign, the Democrat Party used contrived disinformation in a conspiracy, in a conspiratorial way, to deceive the American voter ahead of the election."
Brock has been sharply critical of his former agency for allowing the Russia collusion probe to continue for two years without an adequate predicate or strong evidence.
He said Sussmann's approach to the FBI must be looked at in a larger context that the Clinton campaign and Democrat Party flooded the FBI, the CIA, the State Department and news media from multiple angles trying to sell the Russia collusion story with flawed evidence like the Steele dossier and get an investigation started.
"This is much more than an attorney for the Clinton campaign lying to the FBI," said Brock. "He is using this charge to expose a larger story, a larger narrative."
Durham "called it a joint venture of conspiratorial actions that contrived information," Brock explained, referring to Durham's recent court filings. "... Certainly the American people were defrauded."
Brock also expressed concern about the Homeland Security Department's newly created Disinformation Governance Board, saying it would be a mistake for the agency to use it to referee Americans' speech and that it is ripe for political abuse.
"I think that disinformation is in the eye of the beholder," he said. "I think most people suspect that all of this information will be information promulgated by one political party rather than the other. And so the danger of a governance board like this is that it will be be beholden to the party that's in power in government at that time to silence or mute opposition viewpoints.
"Now, DHS, the secretary has gone to great lengths to say 'No, we're just interested in countering Russian disinformation or Chinese disinformation on social media platforms," he added. "But it's something that should be treated, and I think we are looking at it as something to be wary of."

Here’s reality: 4 millions employees in the executive branch and over 8 years, zero indictments? Hardly true, but the legacy media has ignored all the indictments of people serving him in the upper echelons since, of which there are many. It also helps that Obama had complete control of the DOJ and protected his minions with total alacrity from media criticism. Care to explain the admittance that he sicked the IRS on conservatives? But it's not over. As we speak there's a grand jury in Georgia looking into his attempt to overturn the election there. And even though we know he's guilty, the DA gets continual death threats and has been called the N word more times than she can count.

I meant what I said. Let's say the evidence supports his guilt but he gets off on a technicality. Republicans would burn that place down yahooing about the witch hunt was real, independents would skew right and we'd probably lose some conservative Dems as well in disgust. Which would then pave the way for him or another Trump like figure to take the WH and rule like the true authoritarians they are. They'd be bulletproof and they'd know it and democracy "as we know it" would be over.

I was wrong about one thing. Durham’s investigation did produce one other indictment other than Sussman, who was exonerated by a jury. That one still has to go to trial.

I had very little confidence anything would come out of the hearings from the start but I did think that there would be a fall guy before the Clinton's were implicated. I've said for a while that we have a dual justice system.

Look no further than this where two individuals were caught both throwing molotov cocktails into a police car and had a car full of additional bombs........feds/DA suggesting a substantially reduced sentence for both.

if the coast was going to fall into the sea, I'd be investing in interior farmland and perimeter security given how many millions of people will be displaced.
