My wife was accused of copyright infringement yesterday. She makes jewelry and this attack was in reference to a similar but different necklace on the market. The necklace is string with a pendant and tassel hanging from it. All material including the pendant are readily available for anyone to purchase (probably mass produced in china). Nothing special about the string or pendant either. Is there any copyright violation here? I am almost certain that things like this are covered under patent law, not copyright. I'm also almost certain that it is not patentable due to use of off the shelf materials that are made as one in a non unique way. Thoughts?
