The Democrats won’t post a $1 million bond and so the Arizona audit will go on.

The Arizona Mirror reports this evening:

A brief weekend pause in the Arizona Senate’s election audit that a judge ordered on Friday won’t happen because the Arizona Democratic Party declined to put up a $1 million bond that the judge requested to cover any expenses that the Senate wrongfully incurs due to the halt.
Maricopa County Superior Court Judge Christopher Coury ruled that the audit must halt from 5 p.m. Friday to noon on Monday. But that order was contingent on the Arizona Democratic Party, which brought the lawsuit seeking to block the audit, posting a $1 million bond to cover any expenses that the Senate wrongfully incurs due to the delay. The Senate’s lease of Veterans Memorial Coliseum, where the audit is being conducted, ends on May 14.

The Mirror also reported:
Roopali Desai, the Democrats’ attorney, said the party won’t put up the bond. That means the audit will continue uninterrupted.

Nonetheless, the audit will still have to comply with several other orders Coury issued during a hearing on Friday. The judge ordered the Senate and its audit team to comply with all laws governing the right to a secret ballot and the confidentiality of voter registration data. He also ordered that the auditors use only red pens on the audit floor, an issue that came up after an Arizona Republic reporter who’s working as a volunteer observer noted that the auditors were using blue pens, which could irrevocably harm ballots…
…Attorney Kory Langhofer, who represents the Senate, argued that the lawsuit should be barred by lawmakers’ legislative immunity from being served with lawsuits during the legislative session. He also argued that the Democratic Party and Gallardo lack standing to sue, and that the lawsuit violates the separation of powers between the legislative and judicial branches.

I saw that the "auditors" had placed blue pens on the tables, which are strictly prohibited in audits because they can be read by the ballot scanners.

So my question is: Did they do this because they are inept and unaware of proper auditing policies, or because they are trying to manufacture the alleged fraud that they are searching for?

It's one of those two.

Edit - also, Cyber Ninja has exactly, literally, zero experience conducting an election audit.

I am not running the audit. Just watching for results, so I have no comment on it other than I strongly feel that the group running the audit will get it done correctly if allowed to by the courts.

So you are willing to fully ignore that an obviously-biased firm with no experience auditing elections began the process with a major mistake. And they also promised full transparency, but are now fighting in court to keep the process secret.

But you don't have any comment on that because you are "not running the audit". Right. Because not being directly involved with these things has really kept you from sharing your thoughts on them.

This is such a gross overreach from the state legislature. The SOS Republican has run multiple audits already.

This is political theatre at best. At worst, it is trying to steal an election.

Serious question--would you be ok with Dem states now or in the future having their legislatures seize power over recounting ballots? Is this a recipe for stable democracy? Grant that legislature the authority to pick a partisan body to oversee the counting--keep out or strictly limit any nonpartisan viewers, get caught on tape actually screwing up??

Everything that actually didn't happen in the vote count in Nov.--scary ballots under the table!!--that Repubs whined about is actually happening here...you can't make this stuff up.

And just like here--it doesn't need to be based on any evidence shown in court--just the FEELINGS of voters and state legislatures.

Goodbye rule of law--hello Republican hurt feelings and doing whatever it takes to appoint an undemocratically elected leader--DESPOT TRUMP (as in--you want a king and to overthrow democracy).

And by the way, If there was a reasonable answer to the question about the blue pens other than "It was a mistake" or "They are trying to mark ballots themselves", you and the Hoft brothers would already be trying to spin it. But there isn't. They were either completely unaware of a basic auditing procedure or they are trying to cheat. You choose. Not commenting because you are "not running the audit" is a weak cop-out because you simply have no other possible answer then the choices you were given.

Blue pens is a non issue. Dems and lib run media are desperately trying to drum up any little factoids they can find to throw the legitimacy of the audit in doubt. Thats my answer. Good honest people running this audit.

Red ink. This is used during hand counts, as well as any signatures from election day inspectors.

As noted above, red is basically a safeguard against any slip of a pen marking a ballot.

"If there were to be any inadvertent stray mark, it wouldn't be counted," Gilbertson said.

When Republic reporter Jen Fifield pointed out the blue-ink pen issue to Doug Logan of Cyber Ninjas, the firm doing the election audit, he at first said blue pens were acceptable because the machines only could read black ink. He later questioned his response and said he would look further into the matter. The blue pens were switched out for green pens before any real ballots were taken out of the boxes.

LOL. You just confirmed that Doug Logan and his Cyber Ninjas did not know that blue ink was unacceptable, and had to be told as much by a reporter before switching them. Thank you so much for proving my point!

It doesnt mean shit. Cyber ninjas is going to be using technology first and foremost on this audit. The idea of them manually inspecting all ballots and marking them is way overblown.
