Why are we trying terrorists in civil courts, when we are at war?

There were Executive orders passed, which became law when the president signed it into the federal register, That allow the president to commit a certain number of troops without declaring war.

If that's your point though, then are we illegally detaining prisoners? And who was this POW that the current administration just paraded around after negotiating with terrorists for his release? Semantics.

The point remains, if we have prisoners who are considered terrorists or POW, and they aren't US Citizens, why are they being tried in a US civil court? Where do we find a jury of their peers?

I think it's a legitimate question, politics aside. Should they be tried in civil court?
