Yes and no. Need more info. Has there ever been an issue with this driver before? If it comes out that there was a prior incident or complaint with this driver and the employer (I’m guessing the state in this instance? Or does the state contract out bus drivers?) did nothing about it, then the employer is negligent as well. There’s a progressive range of evaluation to events:
Accidental - Negligence - Fault
Someone slipping and falling around my pool with standard pavers is Accidental on the individual. Not my problem.
Someone slipping and falling around my pool with slick Travertine is Accidental to Negligence on the individual depending upon how much I’ve educated them. If I didn’t say a thing, it could be on me. Is the Travertine company ever responsible? No.
This bus driver is completely Negligent in her job and causes the “injuries ” and the resulting fault lies with her and her only. Her job is to ensure safety of children, period.
Regardless of her training, an adult not being able to handle the simple dismissal and safety to the sidewalk of the child is this woman’s fault, not a bus company or school district.
But yeah, let’s raise the cost of living everyday because we dip into the pockets of other citizens to pay for negligent and faulty individuals.
It is too easy to take money from corporations from shit like this. It’s also too easy for corporations to skate away from BIG MONEY theft like mortgage crises.
Of course if there’s a track record of negligence by the bus company on this individual. That’s personal accountability not taken by them.Yes and no. Need more info. Either way the employer will be held liable to some degree, how exposed they are depends on other factors.
A little off topic but in the same area, we’re getting to a place societally where we need to revisit qualified immunity for police officers.
Fact is she has to watch the child until they are safe and she failed badly on that.Of course if there’s a track record of negligence by the bus company on this individual. That’s personal accountability not taken by them.
But in all seriousness, is what you saw in that video “accidental”? If we allow that type of judgement, we have no nor want any standards of acceptance by personal responsibility as individuals.
I don’t even have “that” level of completion. Safe is a relative term. Her job is to get that kid to proper pedestrian priority space which usually is the sidewalk. A lot of shit can happen after that.Fact is she has to watch the child until they are safe and she failed badly on that.
I would say its more like people are careless and dont really pay close attention to things going on. You can see this every single day by just going for a drive. People are idiots and have zero awareness to whats going on around them...I don’t even have “that” level of completion. Safe is a relative term. Like an Amazon driver. The responsibility is to deliver the package to the front door region. Not toss it out the window, not rip the bag open because you closed the door on it.
Once delivered to the proper region, it’s no longer on the driver.
But that bus driver INTENTIONALLY executed negligence on her own. And unless there is a MASSIVE laundry list of complaints of gross negligence/fault against her in the past, it’s not the taxpayers job to handle it.
It’s like someone killing another “cleaning” a gun with the IDK there was a bullet in it bullshit defense. Sorry, there is no accidental shooting, ever.
Either weapons are so poorly designed by the manufacturer to HIDE bullets from their user as a form of deception to intentionally create these scenarios, and therefore most to all guns need to be recalled. Or the user is so incompetent and negligent that they are a hazard to society. Can’t have it both ways.
