If you have spent less than 2 years at a college, from signing date, you have to sit a year. No exceptions.
If 2 years passes... Have a time period, say 12-1 to 5-1 for announcing portal but only way a player can enter portal is if they have a scholarship offer signed and the accepting school pays 25% of last year's tuition to the previous institution. This is the guideline for same year transfer. If not met, player would have to sit a year.
