We are a Constitutional Republic. So yes, anything not otherwise enshrined in the US Constitution is a matter for the states. That is also a concept known as federalism. Surly this is all familiar to you? These were deliberate controls put in place to protect our unique system from the well-known failures and weaknesses of a pure democracy.Interesting.
