There is no other crime per the DOJ so its not a felony. DOJ would need to charge and convict him of this crime before NY can charge him with a felony. NY putting the horse before the buggy. Its like charging somebody with resisting arrest when there was no crime to arrest somebody for. NY is claiming a federal crime that Trump hasnt been ever charged with or convicted of by the feds. In fact the feds said no crime had been committed. But NY said fuk that we are charging even though they dont have the legal authority to charge federal charges...
Then you have nothing to worry about if you want Trump to get away with it. It's a very high bar to clear and it stands a good chance of backfiring since it's not settled law.
I personally didn't want this trial to come first, as I think it's the weakest, though I feel like there should be painful consequences for squashing the story the week before the election. That saved him from a sure loss but created a nightmare for America that seems to never end.
