I for one fully endorse these former J6 prosecutors going public. There is no better way to demonstrate their arrogance and partisanship and dishonesty better than watching them run their mouths on MSNBC.
Here again is Ashley Akers, who handled many J6 prosecutions--which included the unlawful use of 1512c2, obstruction of an official proceeding.
Ashley, like others, are very offended that new DC US attorney Ed Martin is conducting an internal inquiry as to why prosecutors brought that post-Enron statute for the first time against political protesters--at least 300 were indicted on the felony count.
She calls Martin's inquiry a "wild goose chase," mocks the idea that a preliminary report can be finished this Friday, and notes backup documents related to 1512c2 charging decisions could consist of tens of thousands of pages.
She also downplays the Supreme Court ruling (6-3) that concluded the DOJ--including herself--misapplied the statute which requires proof of evidence/document tampering.

Of course they did.
Chief Justice Roberts in Fischer: "[The government's] novel interpretation would criminalize a broad swath of prosaic conduct, exposing activists and lobbyists alike to decades in prison. Nothing in the text or statutory history suggests that subsection (c)(2) is designed to impose up to 20 years' imprisonment on essentially all defendants who commit obstruction of justice in any way and who might be subject to lesser penalties under more specific obstruction statutes."
Further, after Fischer, the DOJ MOVED TO DISMISS 1512c2 PENDING INDICTMENTS. And at the same time, the DC circuit also vacated 1512c2 convictions based on the Fischer opinion.
Now why is that, Ashley? If there was nothing improper about it, why did the SCOTUS ruling effectively unravel the felony heart of the Jan 6 prosecution?
One DOJ official just told the Washington Post why prosecutors went with 1512c2 for the first time against protesters who disrupted a government function.
"We want prosecutors to be aggressive and entrepreneurial—to think of all options on behalf of the American people—and now we want to make them subject to investigation because the Supreme Court reversed course after lower courts had blessed the use of the statute? You want a way to deflate morale, make people cautious and make people scared? I can’t think of a better way to do it.”
I am so sorry, anon DOJ official, that the Supreme Court did what it is supposed to do: rein in reckless prosecutors and lower court judges--keep in mind, Jude Flo Pan, the appellate court judge married to Dem activist Max Stier who also concocted the stupid "Seal Team Six" hypothetical during immunity arguments, authored both DC circuit opinions that barely upheld 1512c2 before she was reversed by SCOTUS--without regard to the "morale" of those responsible.
