Back in September 2021, Jonathan Su, then-Deputy White House Counsel, was in discussions with the National Archives about boxes allegedly held by Trump. These talks delayed the National Archives from referring the matter to the Justice Department until the White House made a “special access request” the following year.
America First Legal stated on social media that these emails confirm the case against Trump was a “sham prosecution” with the Biden White House’s involvement from the outset.
The legal proceedings focused on accusations that Trump took classified documents to his Mar-a-Lago residence after losing the 2020 election. America First Legal emphasized that the FBI raid on Mar-a-Lago wasn’t about securing documents but rather about using the Justice Department against Trump. On September 15, 2022, Gary Stern, NARA’s general counsel, informed colleagues that Su was updated on the missing boxes issue.
Stern wrote that Su was open to meetings involving various parties and mentioned the need for access to notes from the prior administration. This required making a special access request. The National Archives chose not to send a letter to the DOJ due to ongoing discussions between the White House and Trump’s legal team.
The collaboration between Trump’s team and the National Archives was seen as potentially clarifying or resolving the document issue. However, Trump’s team argued the documents rightfully belonged to him, resisting the requests to hand them over. America First Legal argued that the Biden administration’s actions were a pretext for an FBI-led raid at Mar-a-Lago.
