Detained by cops last night (False accusations)

That really sucks and I empathize with you, but assuming everyone was sincere (witness really believed it was you, cops behaved appropriately, etc) I think there’s no blame anywhere. I absolutely understand your feelings but sounds like it played out reasonably.
No. The “witness” was unreasonable and is an asshole. I’m not saying he should be crucified, but I, like others, hate him for what he did. Complete BS.
 
Eyewitnesses are nearly useless. Humans are really bad at identifying strangers, especially when they were stressed, and especially when the stranger was a different race.
Up until I was in the final selection for a gang member who was charged with 2 separate murders 10 days apart and unrelated, I felt pretty good about even GOOD people respecting the law and generally doing the right thing. This was roughly 17 years ago.

I made the comment on my jury questionnaire that I am biased against a known gang member and with a known criminal history. (This of course got me dismissed.)

But what blew my mind, in my same pool of folks, was a husband and wife who had different last names who talked their way onto the jury to make sure he was found guilty. I was just stunned how they were both selected and 1 of them was a “community organizer”. They were jury professionals if you will. Had done 15-20 trials.

Here’s a significant case and the system was rigged somehow. And the guy was totally guilty as hell. But from the get go, people who weren’t even involved set the result.

If he was just making it up or singled the OP out for other reasons, then that’s BS, but his initial description doesn’t suggest that.

Not even close to the same thing. What OP went through was way worse. Just don’t understand why people stink their nose is other peoples business unnecessarily.
If you committed a crime, then it might be because somebody wants people who committed a crime to be caught.

Keep in mind, I'm a bank manager...I have a suit and tie on and I have a bag full of stuff from desk. So at first, I'm thinking "well maybe they think I have drugs" (I'm a young black male, I don't play the race card but it is what it is). BUT the cops walk me upstairs and say "I'm accused of assaulting a man".. It's some guy bleeding from his head but this is what FVKS me up, a "eyewitness" states "he knows for sure it was me".. He pointing at me and everything..it would be one thing if he said "He kind of resembles him or he looks similar".. He straight up said " I saw him assault this man".. So now the West Philly in me comes out and I start snapping.. I'm cussing main man tf out...Now the eyewitness all of a sudden has to leave...Naw, you gonna sit ya ass against the wall until we get this straightened out.. .It's a Philly subway at 8pm and I have a suit and tie on, how the hell you get me confused with anybody?????.. The thing that saved me was when the cops initially stopped me I was on the phone.. I showed the cops I was on the phone for 40mins, how could I assault him? Why would I assault him, I never seen the victim a day in my life.. Eventually I was let go but is it anyway I can press charges or file a complaint about false accusations?? The cops have everyone's info
Wow, that sucks. Glad it worked out OK in the end.
 
It’s astonishing how many false/mistaken eye witness accounts have put people away. Sometimes for life. Prosecutors are all about “winning” and justice is far down the list of their priorities. Sorry for you and glad it didn’t turn out worse.

Appreciate the fact you got to go home on your terms. Things could have turned out a whole lot worse.
 
I am not OP, and I think this just needs to happen to you before you will appreciate it. This witness was sure it was him, only to be wrong. You don’t have any problem with that? I could understand better if he said I think it was him.
People are dumbasses, and the cops know this. If you're trying to convince the cops that you didn't assault someone, think for a second...would it be better to flip out, start cussing, and acting erratic, or would it be better to remain calm because you know you didn't do it?

Oh I don’t disagree with you about this. I was just talking about the witness and the idea no one should be upset with him.

Sorry bro. You deserved better in that situation and at the same time I’m very thankful it wasn’t worse. Keep your head up and don’t worry about the cussing. Be proud of yourself for standing up for what was right. Eye witness is a goober. Eff him.

Dude...you got personally picked out by an eye witness. Its NOT the cops fault. Of course they were going to stop you. Hell... you would do the same thing. Be pissed of at the witness...!

Ewwwww….Burns me up Fella. Hope you are able to at least file a complaint. Something on file to remind those rectum hats they made a mistake. Good luck!
 
Unfortunately statistics show that its more likely to happen to you bc of the color of your skin, but I agree that the cops did their job correctly in this instance. I’ve always said the vast majority are good ones.

I’ve had multiple incidents over the years where I wonder if the office would’ve reacted differently if I didn’t have brown skin. It’s unfortunate.

This. The amount of dependency our Justice system has on eye witnesses and human memory is kind of crazy, especially when you consider that some testimony from eye witnesses come well after the event occurred. but I reckon there’s not much can be done about it.

While we’re sharing stories, I was almost kicked out of school about a week after I arrived on campus. Some frat guys said they “witnessed” me key an RA’s car. Turns out one of them keyed the car himself and had his buddies lie about it because his girlfriend was interested in me (and vice versa TBH).

But I was on my way out after meeting with the University Police until she convinced him/them to recant. I was 18 at the time, with no idea of what was happening or how close I came to having my life screwed up over petty jealousy.
 
People can accuse someone of doing something whether it is in real life or on social media and many jump at the chance to point the finger and convict!!! This sh!t has to be reeled in!!! I'm a white guy, but not only am I worried about everything I say, but also where I go. Crime is just bad in general almost everywhere, and yes, some racial and ethnic bias is going on. I could be accused myself as a white guy as well just because I'm not in a certain social, cultural, or ethnic group. Even in the social media this country is divided by those lines. Now, we almost exclusively have social medial platforms for those on the right (conservatives), and those on the left (liberals). And we see that many don't want to have any shared platforms. Just look at the backlash for a libertarian like Elon Musk trying to acquire Twitter to reform it back to a social media platform for all. We are now almost defined more by the WOKE standing and our political views than we are by our race. I would imagine it might be well said just to say get used to it, because it ain't getting better!!!

Wait what? You heard the husband and wife say”we’re gonna find this guy guilty”? Or that “we protect our community against obvious convicts”?
 
I'm a white guy, but not only am I worried about everything I say, but also where I go.
Can‘t understand this perspective for the life of me. You belong to the safest, most secure demographic in America. Don’t do or say stupid things and you’ll be fine.

JMO, but you'd have to figure out their intent. They were going out of their way to help someone, or they may have been trying to cover for someone else. Without knowing their intention, it's impossible to judge.

They did not directly say it that way. It was just some of the comments made as we were waiting to be questioned.
But, they were making sure they got on the jury.
Let’s put it this way. When the defense attys had open Q/A with the jury pool based on their questionnaire(400 questions I kid you not), I wondered if they would ever find or question me on my response (all hand written). We had filled them out 2-3 weeks prior and they brought us in 14 jurors at a time with a total pool of 200+.

The question was something like: “Does it matter to you that the defendant is a member of a gang”?
I said, “ I believe that a person who claims to be and is a gang member will have a higher probability to commit a crime. This is based on statistical facts.”
(I didn’t even express prejudice just factual honesty.)

Me and a pacifist who said she could not sentence the defendant to death if found guilty were the ONLY 2 people questioned on our responses and the only 2 dismissed. Completely unbelievable if you are answering those questions honestly that you wouldn’t be questioned or dismissed as well.

What I’m saying….. people talk their way onto juries. Both of them made the jury. 1 on and the other alternate.

Sorry…I have corrected the message. No I don’t have a problem with it if he sincerely believed it was the OP. As many have stated, eyewitness testimony is largely inaccurate but in that scenario, sounds like it went as it should have.
 
The only thing I'm worried about is.. everyone was recording the situation and I was snapping on the eyewitness using foul language...lets just say "ninja, I will f u up" lol... I dont think it will go viral but due to my position, it could be a issue
That being the case, I would leave it alone. It sounds like the witness probably has a better case against you then you do against him. Generally, threating someone for making a mistake is frowned upon.

Actually, I am horrified.
But this is the Society we have allowed to evolve.

I will include prayers for you and your family and .....all 'involved'.......on this the anniversary of the Deepest Darkest day in History.

I will do so again Tomorrow, when we remember & exclaim "He is Risen!"
