Detained by cops last night (False accusations)

I disagree.
Maybe, it is hard to determine the witness's motive. Did the witness really believe it, was it some game, or just a douche that doesn't realize words matter. Either way people shouldn't speak in absolutes. Like the OP mentioned the witness stated it as fact vs. saying it looked like him, etc. People are sloppy with words, accusations, and quick judgement without all the facts. Douche move in any event.

Having recently dealt with intentional false testimony, I definitely feel for OP and glad it turned out fine.
 
my dad said he was arrested for robbing a jewelry store. they took him to the jewelry store and the clerk said it was him! he said--you better look again, it wasn't me (almost sounds like a threat?). anyway, the clerk said maybe it was someone else---and he was let go.... eyewitnesses are not very reliable.
i know i would not be a great eyewitness---but i would be positive if i said it was the person who did it. how would you be as an eyewitness??
 
Can‘t understand this perspective for the life of me. You belong to the safest, most secure demographic in America. Don’t do or say stupid things and you’ll be fine.

You should talk to the white girl who got the black conservative sheriff from Texas to come to Pittsburgh to speak at a college there. Not only did the black students (and a few white students) boo the sheriff from outside the entrance door to where he was speaking, and beating on the door hurling insults and racial remarks to the black sheriff, the mob chased the white conservative student (girl) who organized the event into the dorm, and she had to hide in a men's restroom while she heard them trying to get into some classrooms to find her, and shouting to the other to find her, and get her. So, don't give me that bulls!t that I'm safe just because I'm white!!! But, because I'm a white conservative, I am not safe to go a lot of places, or go on a lot of social media sites. Yeah, as long as I keep my mouth shut and basically do nothing, I MIGHT be OK. But, if they even caught wind of the fact that I was a conservative, then things likely don't end well. But, isn't this kind of prejudice and bias the basis of your comment? And that may be a demographic that you also hate as well?

Hating people because of ideological differences is idiotic. As is the idea that you are not “safe” as a white, conservative male. Unless we have different definitions of the word.

I'm walking down the subway steps to get on the train to go home when two cops say "hey you against the wall".. Keep in mind, I'm a bank manager...I have a suit and tie on and I have a bag full of stuff from desk. So at first, I'm thinking "well maybe they think I have drugs" (I'm a young black male, I don't play the race card but it is what it is). BUT the cops walk me upstairs and say "I'm accused of assaulting a man".. It's some guy bleeding from his head but this is what FVKS me up, a "eyewitness" states "he knows for sure it was me".. He pointing at me and everything..it would be one thing if he said "He kind of resembles him or he looks similar".. He straight up said " I saw him assault this man".. So now the West Philly in me comes out and I start snapping.. I'm cussing main man tf out...Now the eyewitness all of a sudden has to leave...Naw, you gonna sit ya ass against the wall until we get this straightened out.. .It's a Philly subway at 8pm and I have a suit and tie on, how the hell you get me confused with anybody?????.. The thing that saved me was when the cops initially stopped me I was on the phone.. I showed the cops I was on the phone for 40mins, how could I assault him? Why would I assault him, I never seen the victim a day in my life.. Eventually I was let go but is it anyway I can press charges or file a complaint about false accusations?? The cops have everyone's info

This kind of bullshit needs to go away.
 
Eyewitnesses are nearly useless. Humans are really bad at identifying strangers, especially when they were stressed, and especially when the stranger was a different race.
This has been proven over and over. People are awful at it.
 
People are dumbasses, and the cops know this. If you're trying to convince the cops that you didn't assault someone, think for a second...would it be better to flip out, start cussing, and acting erratic, or would it be better to remain calm because you know you didn't do it?

fighting with police really does not help your case

be compliant and usually it will work out

don’t fight argue curse be belligerent or I can assure anyone that the tone you exhibit will send the confrontation down the wrong path

The only way the race card is played is if the "eyewitness" played it. The eyewitness pointed you out, not the cops. This was the furthest thing from profiling by cops. Using the race card is BS in this instance if you're pointing at the cops. Truth.

Please file a complaint against the officers involved. If this was a one time screw up, then nothing will happen. However, a history needs to be established if mistakes continue to be made.

The cops detained a guy that was pointed out by an eyewitness committing a crime; they quickly investigated the allegations and determined that the guy being accused was innocent so they released him. Everyone went home. Seems like good police work to me - it inconvenienced OP but it wasn’t the cops fault that someone misidentified him.
 
I'm a very logical and rational person.. I dress like the average blk male from West Philly 90% of the time if I'm not working... White tee's, timbs etc.... So even if I was dressed like that, I wouldn't have really been THAT upset with the eyewitness(I get it, we all kind of look alike).. BUT my very first boss working in the bank was the best dressed person I ever met, and he said " the way you dress will demand respect, before you even say word, your clients will have a vested respect for you".. I took that advice and RAN with it... I wear custom suits and all that, so again how did you get me confused 8pm at night on a Philly subway??? I exploded cuz main man was basically pointing at my chest saying "I seen him punching and kicking him, it was him, I'm certain".. In all honesty, it took everything in my power not to sock the shit outta him.

Seems like the fear of the moment scares most witnesses into making false claims.

Happens everyday since Jesus died on the cross and miraculously survived only to turn into a ghost and dissolve into the atmosphere into another dimension

I'm a very logical and rational person.. I dress like the average blk male from West Philly 90% of the time if I'm not working... White tee's, timbs etc.... So even if I was dressed like that, I wouldn't have really been THAT upset with the eyewitness(I get it, we all kind of look alike).. BUT my very first boss working in the bank was the best dressed person I ever met, and he said " the way you dress will demand respect, before you even say word, your clients will have a vested respect for you".. I took that advice and RAN with it... I wear custom suits and all that, so again how did you get me confused 8pm at night on a Philly subway??? I exploded cuz main man was basically pointing at my chest saying "I seen him punching and kicking him, it was him, I'm certain".. In all honesty, it took everything in my power not to sock the shit outta him.

That sucks. Sorry that happened to you but glad nothing serious came of it.

It has been a while, but I have been pulled no fewer than 3 times in Rock Hill for looking suspicious or for searching for someone matching my description… mind you I’m about as average Joe looking as they come. It’s not fun dealing with that and can be quite nerve wrecking. Fortunately for me though it was always a real quick detaining but it does make you question cops motives sometimes.

Same thing I said. The cops get all the crap they can handle....much deservedly so. Not in this instance....which is how the the overwhelming majority of police encounters end. It would be interesting to know the race of the "eye witness" gone blind and stupid.

I’m glad you were able to prove your innocence from obscene accusations with basic logic and conventional wisdom.

that’s ridiculous this occurred. They should literally turn right around and arrest false accusers on the spot and those should be prosecuted for damages.

I had a hot cup of coffee spilled on me by the Easley police dept back in the day causing burns.

But back then I deserved it because of my behavior.

I'm not black. I was just an asshole.

Oh, man, I get it. There are few things as infuriating as someone falsely accusing you of doing something.

Not exactly the same situation, but maybe it is similar--My dad and I were at the 1993 ACC Basketball Tournament in Charlotte. It was Saturday, we were playing GT, and there were some calls that went against Clemson in the last minute or two.

We were sitting on the floor, maybe 10-15 rows behind the Clemson basket in a Clemson section. Fred Barakat, the ACC Director of Officials, was down there too, and a Clemson fan yelled something nasty to/at him.

Then a policeman came over and accused my dad of yelling that and threatened to arrest my dad. My dad absolutely lost his cool at the cop, and I had to push my dad back down into his seat. Another nearby fan and friend also jumped in to my dad's defense. It's the only time I ever saw my dad ready to fight anyone.

So yeah, whatever happened and caused that guy to falsely accuse you, I get how easy it is to lose your cool in that situation...

Coming from a white dude NOT kicking the shit out of the guy was the correct response

I have been in that situation before and losing one’s cool definitely causes a huge problem

of course we want to especially me have people tell the truth but that just ain’t gonna happen so we all have to learn to deal with the crap

JMO, but you'd have to figure out their intent. They were going out of their way to help someone, or they may have been trying to cover for someone else. Without knowing their intention, it's impossible to judge.

reading and I have to say this is the heart of the argument

if the Eye witness was completely being honest then it was an honest mistake

however there may have been some bias in the witnesses heart

hard to say but I would have been upset being accused but you need to keep your cool and need to respect the police as they have a job to do and have to sort out the truth as best they can both by witness statements and forensic evidence

having a legal system we use as a guideline is a key to a socially just society

I will have some people freak out when I say this but for example when I viewed particularly the video of George Floyd and the attempted arrest on outstanding warrants I have to conclude that the police were far from guilty of murder

they used.very bad restraint techniques and at best the charge should. Have been man slaughter

I am not saying that I am in favor of even want to see anyone ever injured or killed while being apprehended or takes into police custody

I am just saying when the police say you are under arrest you comply and do what they say

the BLM movement and Social Justice movement are not really meant to help all people particularly. Black people have a more just society

it’s about a power grab for a few and money leeching off those who have it

the huge amount of black on black crime is out of control as I have many black friends telling me the Hell with BLM as they are buying big houses and spending money on themselves

Because I am involved with some projects that are involved in making communities safer I am hearing grass roots opinions

the MSM and racism whores are screaming as loud as they can to extort money from places who avoid being called racists and a huge black population is getting screwed over by those racist Mongering whores

mad a people we all deserve better and my black friends are all on board with more police and police funding

I am totally on board with better training and techniques to apprehend safely and without injury wanted suspects by police

when a problem does occur we need lawful calm collected investigations and not more mayhem rioting and crime

bad police conduct or handling of a matter is not improved by crazy

it is improved by people who want love and good to rule the day
