The Supreme Court has already said he can't use a wartime act to justify his actions so they have basically ruled that immigration isn't equivalent to an invasion.

If the Trump White House disagrees, they have their lawyers go to court and defend it. If they lose, they see what the court is objecting to and change that section to align with the law.
