Trump To Suspend Habeus Corpus? Done By 4 Previous Presidents - Democracy Under Threat

Habeas corpus, the legal principle ensuring individuals can challenge unlawful detention, has been suspended in rare historical instances, typically during times of extreme crisis when governments prioritized security over civil liberties. Below is a brief summary of notable cases and their reasons:
  1. United States - Civil War (1861–1865):
    • Why Suspended: President Abraham Lincoln suspended habeas corpus to suppress Confederate sympathizers and maintain Union control, particularly in border states.
    • Reason: The Civil War posed an existential threat to the U.S. government. Lincoln argued that detaining suspected rebels without trial was necessary to prevent sabotage and rebellion, especially in areas under martial law. The suspension was controversial and later challenged, but Lincoln justified it as a wartime necessity.
  2. United States - World War II (1941–1945):
    • Why Suspended: Habeas corpus was effectively suspended for Japanese-American citizens interned under Executive Order 9066 and for certain military tribunals, such as in the case of German saboteurs (Ex parte Quirin, 1942).
    • Reason: National security concerns during wartime. The government feared espionage and sabotage, particularly after Pearl Harbor, leading to mass internment and swift military trials to deter enemy activities.
  3. United Kingdom - World War I and II:
    • Why Suspended: Habeas corpus was curtailed under the Defence of the Realm Act (1914) and emergency regulations during WWII, allowing detention of suspected spies or collaborators without trial.
    • Reason: To counter espionage and protect national security during global conflicts. The government viewed these measures as essential to prevent internal threats and maintain wartime stability.
  4. United States - Post-9/11 (2001–2008):
    • Why Suspended: The Military Commissions Act of 2006 temporarily suspended habeas corpus for "unlawful enemy combatants" detained at Guantanamo Bay.
    • Reason: The War on Terror prompted the Bush administration to argue that detainees, classified as threats to national security, required indefinite detention without standard legal protections to prevent terrorism. This was later challenged and partially overturned in Boumediene v. Bush (2008).
Common Theme: Suspensions of habeas corpus typically occur during perceived existential threats—wars, rebellions, or terrorism—when governments claim that normal legal processes could undermine security. These actions often spark debate over balancing civil liberties and safety, with courts or later administrations sometimes restoring protections after the crisis subsides.

This is so insane. This isn't an invasion. We aren't at war with illegal immigrants. Honestly what is MAGA smoking?

1. The number of illegal immigrants in this country is significantly less than MAGA is claiming.
2. The amount of money spent on illegal immigrants is significantly less than MAGA is claiming.
3. The amount of "crime" illegal immigrants "commit" in the United States is significantly less than MAGA is claiming.
4. This is clearly going to give the President more power to do whatever he wants, which is significantly MORE dangerous than MAGA is claiming.

Numbers 1-3 have been proven multiple times on THIS stupid Politics forum. It's not hard to find. MAGA and all of you cult members suck at the teet of narcissism and disinformation. Grow up

What are WE smoking? WE already voted on this. Immigration was the 2nd biggest issue in the election. Trump won resoundingly.

It is 100% an invasion.

Our finances are under attack and we face an existential threat through bankruptcy. People are getting killed. Laken Riley says hello.

Trump just doesn't give a fvck anymore. All the dirty tricks are coming home to roost.

We aren't giving the President any more power, he already has the power. See historical precedent.

Do it now! The precedent is there.

Delusion must be a helluva dopamine hit. I guess enjoy since you can't get your bricks off elsewhere

He has the right to suspend Habeus Corpus and I hope he does so.
That wasn't what I was arguing but since the actual numbers of illegals is 1/4 of what magas continually claim, the drastic measures you bandy about aren't needed IMO.

No he doesn't. We aren't at war or under an organized attack.

The Supreme Court has already said he can't use a wartime act to justify his actions so they have basically ruled that immigration isn't equivalent to an invasion.

Did you ever stop and think that maybe all of these judges as well as a staunchly conservative supreme court might be right?

Im not saying they are wrong.

Im arguing that Trump has the power to do it and the precedent has been set. He should do it.

Republicans should rule powerfully just like Democrats do. That's what you guys want, right?

Or do you want two sets of rules?

2 million invaders?

Suspend Habeus Corpus
Asylum seekers aren't invaders. The Supreme Court has already ruled on this.

i'm just asking that you stop contributing to the fake propaganda numbers - do you trust Grok or not?

Best Estimate:
"Based on available data, approximately 2.5 million to 4 million migrants likely entered the U.S. illegally and remained during Biden’s term. This includes:
  • 2.5 million released into the U.S. after encounters (many awaiting asylum hearings).
  • Up to 1.5 million gotaways, though not all may have stayed permanently.
This range is far lower than claims of 8–51 million but higher than under Trump’s administration, reflecting increased border encounters and policy shifts. For precise figures, official government reports from CBP or DHS are the most reliable sources, though they require careful interpretation due to the complexities of immigration data."

It doesnt matter if its 5 million, or 1 million.

They are invaders. They came here unwelcomed. That is an invasion.

What were your comments when Biden said he was going to ignore the Supreme court ruling.

I will do a quick search.

I have never suggested that we ignore the Supreme Court or agreed with that position.
If I remember correctly, in spite of what was said, they did not actually ignore the court did they?

So what are the definitions that you use for an invader?

A large number of people coordinating to break a law is my personal definition.

GROK

The term "invade" has several meanings depending on context, but its primary definitions are:
  1. To enter by force with intent to conquer or overrun: Typically used in a military context, it refers to entering another country or territory with armed forces to attack, occupy, or seize control.
    • Example: "One country invaded its neighbor to seize its resources."
  2. To intrude upon or violate: To encroach on something, such as privacy, rights, or personal space, in an unwelcome or aggressive manner.
    • Example: "The media's questions invaded her privacy."
  3. To spread or penetrate harmfully: Often used in biological or metaphorical contexts, such as a disease or unwanted presence spreading into an area or system.
    • Example: "The virus invaded the host's cells."
Etymology
  • Derived from Latin "invadere", meaning "to go into, enter upon, attack" (from in- "into" + vadere "to go, walk").
Usage Notes
  • The term often implies hostility, aggression, or unwanted intrusion.
  • In legal or political contexts, "invade" can have specific implications (e.g., violating sovereignty).
  • In casual use, it might describe less severe intrusions (e.g., "invading someone’s space").
If you’re referring to a specific context (e.g., Biden and the Supreme Court, or another scenario), let me know, and I can tailor the explanation further!

He found work arounds.

Like I am suggesting with Habeus Corpus.

Democrats are looking in the mirror. They don't like what they see. This is a good exercise.

He found legal work arounds that satisfied the courts with its legality. That's literally how it is supposed to work. If the Trump White House disagrees, they have their lawyers go to court and defend it. If they lose, they see what the court is objecting to and change that section to align with the law.

I truly don't understand why you are being willfully obtuse about this.

Suspending Habeus Corpus is perfectly legal. It's been done 4 times before.

Imagine wanting the suspension of habeas corpus. Is this actually how stupid we’ve become? We’re actively rooting for the end of our own rights?
No we are rooting to save OUR country. Not the illegal immigrants country.

They can come here in a legal fashion.

This is what happens when you have weak leadership like Joe Biden. Y'all knowingly let a demented man run the coutnry and get us into this position.

This rests at Democrat feet. Your policy caused this crises.

It really feels like you are disappointed in the pretty bad legal representation your MAGA folks are left with. I'm sorry they are letting you down.

I wouldn't want to work for them either when you tell the truth, as the lawyer did when he admitted that it was a clerical error to deport Abrego Garcia and then got suspended. They don't like the truth in MAGA land I guess.

How did i do?

Explain the relevancy?

Also, demented Joe got his bills through the Supreme Court Eventually by following the law. Trump just bitches and whines and tries to break the law. What does that say about your guy?

You said MAGA doesn't like the truth, implying that demorats do.

But y'all fell hook, line and sinker, for "Joe Biden is sharp as a tack". You don't love the truth at all. EVERYONE knew he was compromised yet y'all fell in love with the lie.

Have you read the books his admin is selling? The truth is coming out. He was out of it many years ago and y'all still believed the lie.

Trump is showing us what no cognitive decline looks like.

You believed he would lock Hillary up, build a wall, eliminate Obamacare, and restore peace in the Middle East by now. So far…..

You’re in a cult, wake up. Try to get back to objective reality.

Don't forget the Epstein List getting released day 1, Ukraine ending day 1, and a whole host of other promises he's failed to deliver. You can kind of see why fastball is spiraling so hard this afternoon - it's almost like he's beginning to realize he's been sold a false bill of goods and can't wrap his head around it.

Here’s a guarantee. Trump suspends Habeus Corpus. You lose the house and senate in 2yrs and the pendulum swings so hard the other way you won’t believe what hits you.
Yup, it's already swinging that way. This is Scott Rasmussen's firm.
