Did the Pentagon commit sedition upon a sitting US president?
Three DC National Guard whistleblowers say they WERE ready to be deployed on January 6 on Trump's orders but were held back by the Pentagon in bombshell testimony contradicting Capitol riot committee's story!
The officers, who were with Walker the day of the Capitol riot, will detail how they were on buses in full tactical gear for hours waiting for the go-ahead from the Army.
Additionally, the whistleblowers will reveal how the January 6 Committee did not want to hear their testimony because it corroborated Trump and his allies' claims that the former president did authorize the National Guard days in advance to respond to any violence or unrest on January 6, 2021.
What the government conceded today is that 1512c2 has only been used in this manner against J6ers (something DC circuit already admitted) and would not apply to other disruptive demonstrations that we see on nearly a daily basis.
Thomas, Gorsuch, Roberts, and Kavanaugh pressed this distinction and US Solicitor General had no good answer.
That might help selective prosecution motions.
But the only lifeline for J6ers will come if SCOTUS determines that January 6 was NOT an "official proceeding" in the way the entirety of 1512 describes official proceeding and/or that c2 is tethered to c1 in terms of evidence impairment requirement.
If SCOTUS denies Fischer, the court essentially will create a new federal law that can be read however the DOJ wants to in order to continue criminalizing political dissent. And the definition of an "official proceeding" will continue to expand.

As I noted yesterday, Elizabeth Prelogar totally misrepresented (lied?) how DOJ routinely handles sentencing requests for those convicted of 1512c2.
Under questioning from Kavanaugh about prison sentences, Prelogar tried to make it sound like 1512c2 defendants with other nonviolent offenses (common misdemeanors) only get about 24 months in jail.
She quickly mentioned the "Brock" case--referring to Larry Brock, a man from Texas convicted at bench trial of 1512c2 and 5 misdemeanors--and the "enhancement" recently overturned by DC appellate court in 1512c2 convictions.
So what did DOJ ask for in Brock case? Not 24-26 months as Prelogar attempted to mislead Kavanaugh into believing.
NO--DOJ asked for 60 months in prison.

This is critical testimony exposing the U.S. government as perpetrating a false narrative of events for January 6 to frame Donald Trump as participating in a treasonous "insurrection" when the opposite was true.
The President of the United States had pre-authorized the deployment of 10,000 National Guard troops and delegated this responsibility to the Secretary of the Army.
But instead of deploying National Guard troops to secure the capitol during the election challenges in the Electoral College, the Pentagon delayed dispatching troops over an alleged concern for "optics," even as the same government would later call January 6 'an existential threat to democracy.'
The U.S. government allowed the January 6 riots to happen in order to frame Donald Trump and his supporters as 'insurrectionists.' It is simple as that.
