Did the Pentagon commit sedition upon a sitting US president?
Three DC National Guard whistleblowers say they WERE ready to be deployed on January 6 on Trump's orders but were held back by the Pentagon in bombshell testimony contradicting Capitol riot committee's story!
The officers, who were with Walker the day of the Capitol riot, will detail how they were on buses in full tactical gear for hours waiting for the go-ahead from the Army.
Additionally, the whistleblowers will reveal how the January 6 Committee did not want to hear their testimony because it corroborated Trump and his allies' claims that the former president did authorize the National Guard days in advance to respond to any violence or unrest on January 6, 2021.
What the government conceded today is that 1512c2 has only been used in this manner against J6ers (something DC circuit already admitted) and would not apply to other disruptive demonstrations that we see on nearly a daily basis.
Thomas, Gorsuch, Roberts, and Kavanaugh pressed this distinction and US Solicitor General had no good answer.
That might help selective prosecution motions.
But the only lifeline for J6ers will come if SCOTUS determines that January 6 was NOT an "official proceeding" in the way the entirety of 1512 describes official proceeding and/or that c2 is tethered to c1 in terms of evidence impairment requirement.
If SCOTUS denies Fischer, the court essentially will create a new federal law that can be read however the DOJ wants to in order to continue criminalizing political dissent. And the definition of an "official proceeding" will continue to expand.

As I noted yesterday, Elizabeth Prelogar totally misrepresented (lied?) how DOJ routinely handles sentencing requests for those convicted of 1512c2.
Under questioning from Kavanaugh about prison sentences, Prelogar tried to make it sound like 1512c2 defendants with other nonviolent offenses (common misdemeanors) only get about 24 months in jail.
She quickly mentioned the "Brock" case--referring to Larry Brock, a man from Texas convicted at bench trial of 1512c2 and 5 misdemeanors--and the "enhancement" recently overturned by DC appellate court in 1512c2 convictions.
So what did DOJ ask for in Brock case? Not 24-26 months as Prelogar attempted to mislead Kavanaugh into believing.
NO--DOJ asked for 60 months in prison.

This is critical testimony exposing the U.S. government as perpetrating a false narrative of events for January 6 to frame Donald Trump as participating in a treasonous "insurrection" when the opposite was true.
The President of the United States had pre-authorized the deployment of 10,000 National Guard troops and delegated this responsibility to the Secretary of the Army.
But instead of deploying National Guard troops to secure the capitol during the election challenges in the Electoral College, the Pentagon delayed dispatching troops over an alleged concern for "optics," even as the same government would later call January 6 'an existential threat to democracy.'

- no indication of help arriving is seen on video footage for 10 WHOLE MINUTES until 2:50
- she was finally placed into an ambulance at 3:02 and she died at 3:15.

“I think a very plausible argument can be made that through no fault of his own, President Trump’s command authority over both the D.C. National Guard and the U.S. Army itself had been surreptitiously curtailed by the senior leadership of the Army on January 6, 2021,” Col. Matthews, told The Daily Mail in a May 3 interview.
“Army leadership had unreasonably anticipated an ‘unlawful order’ from the President, an order that the President had no plans to issue, and were preemptively seeking to curtail his discretion to issue such an order,” he added.
The remarks by Col. Matthews dovetail with the contents of a book written in mid-2021 titled “I Alone Can Fix It” that claims then-Chairman of the Joint Chiefs of Staff, Gen. Mark Milley, and other military leaders informally planned for different ways to disobey potential orders issued by President Trump that they disagreed with.
The DOD did not immediately respond to a request for comment on Col. Matthews’s claims.
On Jan. 6, 2021, Col. Matthews was serving as the top attorney to Maj. Gen. William Walker, who at the time was the commanding general of the D.C. National Guard.

In the first 4 months of 2024, the DOJ has arrested 159 more people in connection with J6. 2024 arrests are running at close to double the rate they were in 2022 and 2023.
In total 1424 suspects have been arrested in connection with J6.
1207 people were charged with entering and remaining in a restricted building, a misdemeanor.
127 people were charged with entering and remaining while armed with a deadly or dangerous weapon, a felony.
Of the 1424 suspects charged, 355 were charged under an obscure federal Enron statue which has never been used for out of hand protests so that their misdemeanors could be upped to a felony. That charge is pending a review from the United States Supreme Court. 510 were charged with assaulting, resisting or impeding officers.
0% of the charges have been dropped.
Not one SINGLE person has been charged with the crime of insurrection.
Let's put that into context.
During the George Floyd riots, an examination of all of the charges revealed that 90% of the charges filed were dropped. Some highlights:
Dallas - 675 charges were dropped after arrests were made, both misdemeanor and felony charges. The 200 that remained were sent to the prosecutor's office who then proceeded to drop 85% of those.
Phili - 1700 charges were sent to Soros funded DA Larry Krasner's office. 95% of those charges were dropped. Only 80 of the most serious cases remained. Most were pled down.
MN- 1,100 cases were referred for prosecution. 85% of those charges were dismissed by DAs.
NYC - 5,000 summonses were written for misdemeanors and every single one of those was dropped. There were 136 cases for serious crimes that were referred to the Brooklyn DA and 82% of those cases were dropped. In Manhattan, there was 1,000 serious cases referred for prosecution and 64% of those charges were dropped.
In case anyone in America wants to see what it looks like when you a have a two-tiered justice system where the laws are selectively applied based on your party affiliation.
