The problem with expedited removal is that it was expanded this year to broadly increase its scope, so it's massively different than what was originally proposed in 1996. The SC hasn't made a ruling on this recent change, so we don't know if it will remain "legal." Due Process is afforded to all persons in the US, but the SC ruled 5 years ago that the original iteration of ER didn't violate the 4th amendment.

Even if you had 500 judges doing this 24 hours a day it would take 300+ years.3. If you answered yes and want to give them due process, can you at least acknowledge that is not feasible?

Regarding your second paragraph - because it's easier for innocent people to get rounded up and sent off. If you don't have a piece of documentation on your person showing that you've been in the US >2 years, or proving that you're there legally you run the risk of being deported without a potential hearing to prove your innocence. They told him his immigration status changed and then sent him to a detainment center in Texas as part of that big El Salvador plane photo op last month. His wife filed a lawsuit which made its way up to the SC who eventually ruled in her favor. It's theorized the reason El Salvador and the admin won't/can't return Abrego is because he's dead. CECOT is essentially a death camp, and he was housed with the same gang that threatened his life back in 2011 which led to his flight to the US.
