I do not care what fox news pundits believe or not related to mass election fraud and its that simple. I have my own opinion on what occurred. This thread is about the lawsuit though and not an argument over whether the election fraud itself occurred or not.

The way I understand things is that the libel suit against FoxNews depends on a couple of key points.

1. The company bringing the suit has to show measurable damages to reputation and bottom line. I suspect that Dominion will have NO PROBLEM showing that with as much bad press as they got from 2020 on. No way that hasn't effected their bottom line.

2. This is the really hard one. The company bringing the suit has to prove that the journalist in questions KNEW and BELIEVED what they were reporting was a lie and kept doing it anyway. This is an extremely heavy lift and rightfully so. I'm just going to pull that top quote again that was on the air:

BARTIROMO: "Sidney, we talked about the Dominion software. I know that there were voting irregularities. Tell me about that."

Look at the bold part there in the context of the Dominion machines. And there's no doubt of the context b/c Dominion was qualified in the previous sentence. She said on air that she KNEW that there were voting irregularities, yet from her texts we know that she didn't believe that.

Again, I'm no lawyer and I don't even know that I want FoxNews to go down for this. I mean I know that you believe Tucker Carlsen and Hannity, and unfortunately a lot of folks do. But when FoxNews' own lawyers argue IN COURT that no reasonable person would believe Carlsen, well...

So, objectively, I'm not 100% sure that there's a case to be made here mostly because these folks aren't reporters, they are political pundits with an agenda that are on record in court as being people that no reasonable person would believe. But that quote above (given the texts that just came out... is pretty damning). We'll see how it plays out.

Bartiromo's words will come back to bite her and the network. You cannot hear these words and say that she wasn't alleging fraud. I don't know if this will be admissible in the Dominion case but she clearly wants her viewers to believe that fraud occurred.

In addition to Trump’s unwillingness to acknowledge Joe Biden won the election, Bartiromo’s unchallenged acceptance of Trump’s false narrative also presents a danger to American democracy, said CNN’s Senior Media Reporter Oliver Darcy on “Reliable Sources.”

“News organizations — and I think Fox claims to be one — have a responsibility,” Darcy said. “The president of the United States is trying to overturn the election. …Frankly, there is not much daylight between Maria and [Infowars conspiracy theorist] Alex Jones.”
